1. POLY’s Property

Any electronic data, files or information provided under this Agreement are the property of Poly, Inc.  It is understood and agreed the information contained in these electronic data files shall not be copied or duplicated for any use other than the project for which they were created.  It is understood by the RECIPIENT that compatibility of this electronic media with other systems is not guaranteed, and conversion to other systems is done at the RECIPIENT’s own risk.  The RECIPIENT hereby agrees and recognizes that designs, plans and data stored on electronic media including, but not limited to, computer disk (including CDROM) and flash memory, may be subject to undetectable alteration and/or uncontrollable deterioration.  It is agreed by the undersigned that POLY shall not be liable for the completeness or accuracy of any material provided on electronic media.

 

2. Hold Harmless

The RECIPIENT agrees to defend, hold harmless and indemnify Poly, Inc. and its officers, directors, employees, agents and consultants for any and all claims, losses, costs or damage whatsoever arising out of, resulting from, or in any way related to the use of electronic data files provided hereunder, whether that use is authorized or unauthorized.  The RECIPIENT further agrees to defend, hold harmless and indemnify Poly, Inc. and its officers, directors, employees, agents and consultants from any and all claims, damages, losses, expenses and injuries including attorney’s fees and defense costs arising out of the modification or use of the electronic data files by the RECIPIENT or by anyone obtaining said files through or from the RECIPIENT.  POLY bears no responsibility for the information in the electronic data files once it leaves POLY’s office.  The RECIPIENT understands that the electronic data files are subject to applicable copyright laws and agrees to be bound by same.

 ADDENDA Automatic email notification for addenda will be provided for all registered plan holders.  Email notification for addenda is provided as a convenience and in no way relieves the Bidder from any omissions that may arise from electronic mail.  Bidders must acknowledge receipt of all issued addenda by signing and dating the “Addendum Receipt” provided with each addendum and faxing it to 334-793-9015. Additional instructions for addenda acknowledgement can be found in the contract documents.

 

It shall be the responsibility of Prime Bidders to insure that Subcontractors and/or Suppliers receive addenda which could impact their respective portions of the project.

An email will be generated from you to the Project Administrator.  All information requested in the email must be provided for an accepted registration.  If access is granted, you will receive an email (via the address provided in the registration form) with the username and password for this project’s bid documents.  You may then download the bid documents as needed. 

 

Notifications will be sent via email for addenda publications.
